Puntualia Terms of Use
Effective November 5, 2026
These Terms of Use (the “Terms”) govern the use of the Puntualia app and its service (“Puntualia”), published by Reverb Technology LLC, a Texas company (“Reverb”, “we”). They are also the app’s end-user license agreement (EULA). By creating an account, creating a company, accepting an invitation or buying a subscription, you accept these Terms. If you accept them on behalf of a company, you represent that you have authority to bind it. If you do not agree, do not use Puntualia.
Please read sections 5 and 10 to 14 carefully. Reverb only provides the tool: the client company is solely responsible for its labor, social security, tax and data protection compliance, and Reverb’s liability is limited to the minimum the law allows.
1. What Puntualia is
Puntualia is a time clock for the phone. The people of a company clock in and out from their own phones, with the server’s time and, if they give permission, the location of that instant compared with their work site’s perimeter. The people who run the company manage people, sites, schedules and corrections, and export the records as CSV files. Puntualia does not calculate payroll, taxes or social security contributions, and does not give labor or legal advice.
2. Accounts and roles
- There are three roles: owner, admin and employee. Whoever creates a company becomes its owner. Only the people a company invites by email can get into it.
- Look after your access: do not share your codes or your password. You are responsible for what is done with your account.
- The information you record must be true. Each person clocks in only for themselves.
- You can delete your account from “Mi cuenta” (my account), as the privacy policy explains.
3. Per-company subscription
Puntualia is bought per company, with an App Store or Google Play subscription or, by exception, with a contract plan with Reverb (see below). The purchase belongs to the company, and only the owner can buy, restore or manage the subscription. Nobody else ever pays.
- Plans and people limit: Chico (small), up to 5 people; Mediano (medium), up to 15; Grande (large), up to 40; Empresarial (business), up to 100; Corporativo 250 (corporate), up to 250; Corporativo 500, up to 500; Corporativo 1000, up to 1,000. The count is the company’s active people, including the owner, plus pending invitations. Once the limit is reached nobody else can be invited until the company moves up a plan or frees places; nobody is deactivated automatically.
- Prices: Chico, Mediano, Grande and Empresarial are monthly or annual; the Corporativo plans are monthly only. For reference, in Mexico, including VAT: Chico MXN $149 a month or MXN $1,499 a year; Mediano MXN $349 a month or MXN $3,499 a year; Grande MXN $799 a month or MXN $7,999 a year; Empresarial MXN $1,799 a month or MXN $16,999 a year; Corporativo 250 MXN $3,999 a month; Corporativo 500 MXN $6,999 a month; Corporativo 1000 MXN $11,999 a month. The price charged is the one the store shows, in your currency, before you confirm the purchase.
- 14-day free trial: the store may offer 14 free days as an introductory offer, once per customer. The store decides whether your account is eligible; the app only mentions the trial when the store confirms it. When the trial ends, the subscription is charged automatically unless you cancel before then.
- Automatic renewal: the subscription renews automatically at the end of each period, monthly or annual, and the store charges the account you paid with, unless you turn off renewal beforehand. In the App Store, that must be done at least 24 hours before the current period ends.
- How to cancel: in the app, “Administrar suscripción” (manage subscription) opens your store’s subscriptions sheet. You can also do it directly in your store: App Store or Google Play. Cancelling stops the renewal; the service continues until the end of the period already paid. Deleting the app or your account does not cancel the subscription.
- Plan changes, failed payments and refunds: moving up or down a plan is done in the store and follows its rules. If a payment fails, the store may give a grace period during which the plan stays active. Refunds follow the store’s policies: in the App Store, Apple decides them; in Google Play, you can ask Google or write to us.
- Price changes: if the price changes, the store tells you and, when its rules require it, asks you to accept the new price before charging it.
- Contract plan: a company may contract a plan directly with Reverb, in writing, with the people limit and the term agreed (for example, for more than 1,000 people). In that case the App Store or Google Play subscription does not apply, and what these Terms say about the free trial, renewal, cancellation and refunds is replaced by that contract. Where the contract is silent, these Terms apply.
4. A company with no plan or a lapsed plan
- No plan: a newly created company, while it has no subscription, can set up the company, its sites and its schedules, but cannot invite people and nobody can clock in.
- Lapsed plan: if the subscription expires, is revoked or is refunded, or if the term of a contract plan ends without being renewed, the data and attendance records are kept and punches keep being recorded. Admins can look, but cannot invite, adjust punches or export until the owner reactivates the plan.
- Courtesy plans: Reverb may assign a free plan to a company under a separate agreement.
5. What the client company is responsible for
Reverb only provides the tool. The company that uses Puntualia is solely responsible for meeting its labor, social security, tax and data protection obligations toward its staff and toward the authorities. In particular, it is responsible for:
- Complying with the labor law that applies to it, including working hours, rest periods, overtime, payment of wages, contributions and keeping its records, as well as the rules the authorities issue on electronic recording of working hours. Puntualia does not ensure that its records meet those rules on their own.
- Telling its staff how it uses their data, giving them its own privacy notice as the controller and having a legal basis to record their attendance and their location when they clock in.
- Setting up its sites, radii and schedules correctly, reviewing reports and punches away from the site, without a location or sent late before using them for payroll or any decision, and resolving corrections fairly.
- Answering for what its admins do and for the files it exports, which are under its control once they leave Puntualia.
6. Acceptable use
When using Puntualia you agree not to:
- Clock in for someone else or ask someone to clock in for you.
- Fake your location or the time with spoofing apps or techniques.
- Use Puntualia to monitor people outside their working hours or for any unlawful purpose.
- Interfere with the operation or security of the service, try to reach another company’s data or decompile the app, except as far as the law allows.
7. License and intellectual property
Reverb grants you a limited, non-exclusive, non-transferable and revocable license to use the app on devices you own or control, under these Terms and the usage rules of the store you downloaded it from. The app, its design and its code belong to Reverb or its licensors. The data a company records in Puntualia belongs to the company.
8. Personal data
How personal data is processed is explained in the Puntualia privacy policy. Reverb processes each company’s staff data only on that company’s behalf and to provide the service, keeps it confidential and does not sell it or use it for advertising.
9. Availability and changes to the service
We work to keep Puntualia available, but there may be interruptions for maintenance or because of network or provider failures. If there is no connection when someone clocks in, the app saves the punch on the phone and sends it when the network returns. We may improve, change or withdraw features; if a change significantly affects companies, we will tell their owners by email.
10. No warranties
To the extent the law allows, Puntualia is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. In particular, Reverb does not warrant:
- The accuracy of the location the phone reports, which depends on the device, the GPS signal and the surroundings.
- The accuracy of the phone’s clock, which the app uses for punches made offline.
- The delivery of the emails with sign-in codes, which depends on third parties.
- That the service will run without interruptions, without errors or continuously.
11. Third-party services
Puntualia depends on services Reverb does not control: the App Store and Google Play, Apple’s and Google’s sign-in systems, internet and mobile carriers, and phones and their operating systems. Reverb is not responsible for their failures, changes or interruptions, or for their charges.
12. Limitation of liability
To the maximum extent applicable law allows, and even if the damage is caused by Reverb’s negligence, Reverb will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost revenue, loss or corruption of data, or for fines, penalties, contributions or labor, tax or social security claims arising from how the company uses Puntualia or its records.
Reverb’s total liability for all claims related to Puntualia will not exceed what the company paid for Puntualia, whether for its subscription in the App Store or Google Play or directly to Reverb for a contract plan, in the 3 months before the event that gives rise to the claim. If it paid nothing in that period, the cap is MXN $149, the price of one month of the Chico plan.
Nothing in these Terms excludes or limits Reverb’s liability for fraud, willful misconduct or bad faith, or any other liability that applicable law does not allow to be excluded or limited, or any rights the law gives you that cannot be waived.
13. Indemnity
The client company will hold Reverb harmless from, and indemnify it against, any claim, fine, damage or expense, including reasonable attorneys’ fees, brought by its workers, an authority or other third parties that arises from the employment relationship, from the company’s use of Puntualia or its records, or from its breach of these Terms or of the labor, tax, social security or data protection law that applies to it.
14. Time limit for claims
Any claim against Reverb related to Puntualia must be brought within 2 years after the event that gives rise to it; after that period it can no longer be brought, unless applicable law requires a longer period.
15. Suspension and termination
You can stop using Puntualia at any time and delete your account from the app. We may suspend or close the access of an account or a company that breaches these Terms or puts the service or other people at risk; when reasonable, we will give notice first. On termination, data is handled as the privacy policy explains.
16. App Store and Google Play terms
If you downloaded the app from the App Store, the following also applies:
- These Terms are between you and Reverb, not with Apple. Reverb, not Apple, is solely responsible for the app and its content.
- Reverb is solely responsible for maintaining and supporting the app. Apple has no obligation whatsoever to provide them.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation with respect to the app.
- Reverb, not Apple, handles any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, Reverb, not Apple, is responsible for investigating, defending, settling and paying that claim.
- You represent that you are not located in a country subject to a United States Government embargo or designated by that government as a “terrorist supporting” country, and that you are not on any United States Government list of prohibited or restricted parties.
- When using the app you must comply with any third-party terms that apply to you, such as those of your mobile data service.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
If you downloaded the app from Google Play, Google Play’s terms of service also apply. For the license to use the app on Apple devices, the Apple standard license agreement also applies to anything these Terms do not cover.
17. Governing law and jurisdiction
These Terms are governed by and construed under the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute will be resolved in the courts of Harris County, Texas, without prejudice to any rights the law of your country gives you that cannot be waived.
18. Changes to these Terms
We may update these Terms. We will post each version on this page with its effective date and, if the change is significant, we will tell each company’s owners by email. If you keep using Puntualia after a new version takes effect, you accept it.
19. Language that prevails
These Terms exist in Spanish and in English. If there is any difference between the two versions, the Spanish version prevails.
